RadSwift DXA Software

Effective date: April 14, 2025

⚠ RadSwift DXA is a data entry automation tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. All clinical decisions remain the sole responsibility of the treating clinician.

Please read these Terms of Use ("Terms") carefully before downloading, installing, or using the RadSwift DXA software ("Software"). By downloading or using the Software, you agree to be bound by these Terms. If you do not agree, do not download or use the Software.

1. Permitted Use

RadSwift grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the Software on computers owned or controlled by you or your institution, solely for internal workflow automation purposes. You may not:

The Software uses optical character recognition (OCR) and related techniques to extract numerical values displayed on DXA scan viewer screens. While RadSwift strives for accuracy, the Software may produce incorrect, incomplete, or missing values due to factors including but not limited to:

You must independently verify all values extracted by the Software against the original DXA scan report before including them in any clinical record, report, or communication. RadSwift DXA is a productivity aid, not a source of clinical truth.

3. Not a Medical Device

The Software is classified as a workflow automation tool and is not intended to be, and should not be used as, a medical device. It does not analyse, interpret, or provide clinical recommendations regarding DXA scan results. The Software does not replace clinical judgment. RadSwift makes no representation that the Software complies with the requirements of any medical device regulatory framework, including but not limited to FDA 21 CFR Part 820 or EU MDR 2017/745.

The radiologist, physician, or other qualified clinician using the Software is solely and exclusively responsible for:

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. RADSWIFT DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT EXTRACTED VALUES WILL BE COMPLETE OR ACCURATE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RADSWIFT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, CLINICAL ERRORS, PATIENT HARM, OR LOSS OF PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Because the Software is provided free of charge, RadSwift's total aggregate liability to you for any claim arising under these Terms shall not exceed USD $0.

7. Privacy and Data

The Software operates entirely on your local machine. RadSwift does not collect, transmit, store, or have access to any patient data, scan values, or personal health information processed by the Software. You remain responsible for ensuring your use of the Software complies with all applicable privacy laws and regulations, including HIPAA where applicable.

8. Updates and Changes

RadSwift may release updated versions of the Software from time to time. We reserve the right to modify or discontinue the Software at any time without notice. We also reserve the right to update these Terms; continued use of the Software after an update constitutes acceptance of the revised Terms.

9. Termination

This licence is effective until terminated. It will terminate automatically if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of the Software and delete all copies in your possession.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RadSwift is incorporated, without regard to conflict of law principles.
